  • Xu Xiaoming, Director of the JAVY Guigang Branch, was invited to deliver a specialised legal awareness training lecture at Guangxi Construction Vocational and Technical College

    To thoroughly implement the fundamental strategy of comprehensively governing the country according to law, and to comprehensively enhance the capacity and competence of key personnel in public institutions—including those in logistics, security, medical services, catering, infrastructure, asset management and general administration—to perform their duties in accordance with the law and regulations and to exercise their powers with integrity, thereby effectively preventing legal and integrity risks. Recently, Xu Xiaoming, Senior Partner at JAVY Law Firm and Director of its Guigang Branch, was invited to Guangxi Construction Vocational and Technical College to participate in the 2026 ‘College Rule of Law Lecture Series’—a specialised legal training session for the Logistics Department, Infrastructure Department and Construction and Science Assets Department. This specialised lecture series closely centred on themes such as law-based administration, standardised performance of duties, risk prevention and control, and integrity building. Grounded in the practical governance of public institutions, it focused on high-frequency scenarios and common risk points in daily work. Using the law as a yardstick and case studies as a mirror, it comprehensively clarified the boundaries of authority, defined requirements for the performance of duties, and delineated disciplinary red lines, thereby promoting the internalisation of a rule-of-law mindset and awareness of ethical boundaries, ensuring these principles are put into practice and yield tangible results.

    The session centred on two core areas—risk prevention and control in key sectors, and reinforcing the responsibility of all staff to perform their duties in accordance with the law—to deliver legal awareness and warning education, covering multiple core operational areas of logistical support.

     

    In terms of specialised operational control, the bottom lines and compliance standards for each post were clarified: at the security level, security personnel were required to clarify the boundaries of their authority, recognise their status as non-police personnel, strictly refrain from implementing coercive measures, regulate their conduct strictly in accordance with the *Regulations on the Administration of Security Services*, conduct routine training and supervision of the team, reinforce the primary responsibility of employing organisations, and avoid risks of infringement arising from the performance of duties; In medical services, the system of requiring staff to hold valid licences and be registered to practise has been strictly enforced; non-professional healthcare personnel are strictly prohibited from carrying out medical work independently; procedures for the drafting and retention of medical records have been standardised; organisational management responsibilities have been clarified in accordance with the Civil Code; the bottom line for medical quality and safety has been strictly upheld; and risks of medical disputes and medical harm have been prevented at source; In the area of catering, we adhere strictly to food safety standards, rigorously verify business licences and strictly control the sourcing of ingredients. We fully implement the relevant provisions of the Food Safety Law, strictly prohibit the entry of expired or spoiled ingredients onto campus, mitigate the risk of punitive damages for food safety breaches, and comprehensively safeguard the dietary safety of staff and students; In the area of infrastructure and asset management, standardise the entire process of infrastructure project approval and construction; strictly enforce the principle of ‘approval before construction and construction with valid permits’; strictly follow the ‘Three Major and One Important’ decision-making procedures when disposing of state-owned assets; and conduct asset valuation and transactions in accordance with the law to prevent the loss of state-owned assets and issues such as non-compliant decision-making; At the general affairs and procurement level, given the capital-intensive nature of this sector and its diverse risk factors, procurement and tender management systems are strictly enforced; irregularities such as circumventing tendering procedures or setting discriminatory clauses are strictly prohibited; meticulous management throughout the entire asset lifecycle is implemented; and efforts are made to promote the lawful and standardised operation of relevant work, thereby fortifying the defences against corruption.

     

    The seminar placed particular emphasis on end-to-end contract management, clarifying that contracts, as a key basis for civil management activities, must underpin the entire business management process. It called for the refinement of essential contractual clauses, the quantification of liabilities for breach of contract, and the clarification of dispute resolution mechanisms, whilst implementing a management model characterised by full-cycle, end-to-end oversight and complete documentation to mitigate contract-related legal risks. At the same time, a specialised integrity warning education session was conducted. Drawing on current judicial interpretations, the session interpreted the latest adjustments to judicial policies regarding official misconduct involving embezzlement and bribery, clarified the sentencing threshold of 30,000 yuan for criminal liability, and, using typical cases of disciplinary and legal violations within the logistics system, provided a vivid analysis of the serious harm caused by official misconduct, warning participants to strictly adhere to the legal and professional boundaries.

     

    Adhering to the guiding principles of upholding political integrity, abiding by the rule of law, preventing risks and promoting the proper discharge of duties, this specialised seminar transformed legal provisions into standardised working guidelines and internalised risk awareness education as a conscious commitment to professional conduct, thereby effectively enhancing the comprehensive capabilities of staff in key positions to perform their duties in accordance with the law, anticipate risks and implement emergency prevention and control measures.
