On November 12, JAVY law firm successfully held the activity of “Skills and Logic of Substantive Defense in Criminal Cases”, and invited Li Yongwei, a lawyer of Beijing JAVY law firm, an excellent lawyer of Haidian District in 2022, and a member of Beijing Criminology Research Society, to be the main speaker.

At the beginning of the lecture, Mr. Li deeply analyzed the subtle boundary between guilt and innocence through three carefully selected criminal cases, and guided the lawyers to explore how to extract the silk from the complicated details of the cases, and then construct a precise and efficient defense strategy.

On the topic of innocence defense, Mr. Li Yongwei made a detailed distinction between factual innocence and legal innocence. He highlighted that lawyers should learn to break the traditional four-element defense framework, and instead adopt a more comprehensive and detailed analysis methodology covering multiple dimensions such as verification of case facts, assessment of the completeness of the chain of evidence, and interpretation of the application of the law, in order to ensure the rigor and effectiveness of the defense work.

In addition, Mr. Li introduced the three main strategies of guilty defense: misdemeanor defense, misdemeanor defense and sentencing defense. He especially emphasized the importance of sentencing circumstances in the defense process, and thoroughly analyzed how the three stages of pre-crime, crime and post-crime profoundly affect the final sentencing verdict. At the same time, Mr. Li also discussed in-depth and insightful defense techniques and strategies in special situations such as plea bargaining and accessory to crime.
