On November 15, JAVY law firm successfully held the activity of “Enterprise Trademark Right Protection and Risk Prevention”, which was presented by Yang Siping, member of Trademark Committee of International Trademark Association (INTA), member of Trademark Committee of International Association for the Protection of Intellectual Property Rights (AIPPI), Beijing Municipal Government, member of Trademark Law Committee of Lawyers Association, and lawyer of JAVY law firm. Ms. Yang firstly introduced the basic knowledge framework of trademarks and brands, meticulously defined the concept of trademarks, the scope of classification, and clearly analyzed the intrinsic connection and subtle differences between trademarks and brands. She emphasized the importance of trademark registration and summarized a series of practical skills to enhance the success rate of trademark registration in light of the actual situation of trademark application in China.

In the process of trademark registration, Ms. Yang especially pointed out how enterprises should accurately select the core protection classes, maximize the coverage of protection and implement defensive registration strategies. Through typical case analysis, Mr. Yang vividly demonstrated the common reasons for rejection in the trademark examination process, and put forward targeted coping strategies and solutions to help enterprises cope with various challenges in the process of trademark registration and use.

In terms of trademark protection and risk prevention, Ms. Yang gave a comprehensive management strategy. She suggested that enterprises should take proactive measures to complete trademark registration in a timely manner, ensure the standardization of use, and establish a comprehensive trademark early warning system to monitor their own trademarks, competitors' trademarks and potential infringement in the market in real time, so as to effectively prevent the occurrence of brand crisis.

Finally, Ms. Yang further emphasized the principle of distinctiveness in the selection of trademarks, encouraged enterprises to conduct detailed trademark searches and risk assessments before the launch of their products, advocated the adoption of a forward-looking strategy, early and extensive trademark registration to build a solid barrier of trademark protection, and properly preserved the evidence of trademark use in order to substantiate brand awareness. In addition, she also reminded enterprises to be alert to the risk of not using their trademarks for three years after revocation, to prevent improper use or dilution of their trademarks, and emphasized the importance of continuous monitoring and timely defense of rights to ensure that the value of the brand is solid and enhanced.
