The use of AI to swap face becomes so popular that it draws widespread public concern, for fear of abusive use of the technology. Recently, JAVY’s partner Li Zonglin was invited to give a commentary on the issue, via Beijing Radio Station’s podcast program “Enforcement & Law Online”.
Ms. Li commented on the recent case where a tech company executive from Fujian was defrauded of 4.3 million yuan by scammers using AI technology, pretending to be his acquaintance with changed face & voice, the victim’s funds was mostly recovered with help from the police later on, but the case is still under investigation. The incident has since drawn much social concern.
As Ms. Li pointed out, this AI swap scheme could be categorized as a typical telecommunication fraud case, victims in such situations should call the police for help immediately so they may have a better chance to recover the stolen funds.
Ms, Li also mentioned that the apps that provide face swap functions may also be held responsible if they failed to adopt required measures pursuant to the law, those measurements include proper user registration, algorithm mechanism review, scientific & technological ethics review, information release review, data security, personal information protection, anti-telecommunication fraud measures, contingency plans, etc. Otherwise, the app providers could be held legally responsible, or even constitutes a crime.
Ms. Li further pointed out that the AI face swap could also means civil law consequences, such as infringement to portrait rights, privacy rights, or copyrights, according to the Civil Code.
