On August 1, 2025, the Supreme People's Court issued the “Interpretation (II) on Issues Concerning the Application of Law in the Trial of Labor Dispute Cases” along with typical case examples. This judicial interpretation officially took effect on September 1, 2025. To assist lawyers in gaining a deeper understanding of this interpretation and enhancing their professional capabilities in labor dispute cases, JAVY Law Firm successfully hosted the event “Key Provisions Interpretation of the Supreme People's Court's Interpretation (II) on the Application of Law in the Trial of Labor Dispute Cases” on September 5, 2025.
Co-hosted by the Ruiya Women Lawyers Community and the JAVY law firm's Brand and Culture Development Committee, the event featured Attorney Liu Wei—part-time master's supervisor at Capital University of Economics and Business Law School and member of the Beijing Lawyers Association's Labor and Social Security Law Committee—as keynote speaker. Attorney Yang Xiaoxi, founder of the Ruiya Women Lawyers Community, moderated and delivered opening remarks. Wei Wei, Chair of the Brand and Cultural Development Committee and Partner at JAVY law firm, was specially invited to deliver remarks at the event.
At the outset of the event, Attorney Yang Xiaoxi provided a brief introduction to the Ruiya Women Lawyers Community. She noted that the Supreme People's Court's Judicial Interpretation on Labor Disputes (II), issued this year, represents a proactive response to practical needs. She expressed hope that this event would establish a pragmatic and cutting-edge exchange platform for the legal profession, thereby enhancing the professional standards of labor dispute resolution.
During the thematic presentation segment, Attorney Liu Wei leveraged his extensive practical experience and profound theoretical expertise to provide clause-by-clause analysis of over a dozen key provisions in the Judicial Interpretation on Labor Disputes (II). He interspersed his commentary with real-world case studies, delivering content that was both accessible and thought-provoking.
Drawing on typical cases released by the Supreme People's Court, Attorney Liu meticulously analyzed critical issues such as the criteria for determining labor relationships, the allocation of employment responsibilities among affiliated enterprises, special rules for arbitration time limits, and principles for determining jurisdiction. Additionally, Attorney Liu extended his analysis to cutting-edge practical issues such as disputes over the calculation basis for double wages, the application of force majeure exemption clauses, rules for automatic contract renewal, and the validity of non-compete clauses. He reinforced practical guidance by citing court precedents from multiple jurisdictions.
During the interactive Q&A session, attorneys actively posed questions on challenging practical issues. The speaker provided clear and actionable answers for each query, integrating insights from the new regulations and judicial trends. The lively discussion sparked continuous intellectual exchanges, with attendees unanimously expressing that they gained significant insights.
At the conclusion of the event, Attorney Wei Wei delivered the closing remarks.
