On August 29, 2025, as the nation solemnly commemorated the 80th anniversary of the victory in the Chinese People's War of Resistance Against Japanese Aggression and the World Anti-Fascist War, JAVY Law Firm successfully hosted a special lecture titled “Cases and Experience Sharing on Innocence Defense” at the “JAVY Lawyer Lecture Series.”

Director Zhao Zenghai of JAVY law firm provided full guidance and attended the event. Over 50 participants, including attorneys from 14 law firms such as JAVY law firm, Lianggao, Zhonglun Wende, Qiancheng, Zhongdun, and Huixiang, as well as journalists from Southern Weekly, attended the lecture in person. The lecture was moderated by Attorney Shi Yujie, Chair of the Criminal Law Committee and Senior Partner at JAVY law firm. Senior Partners Xu Fadong and Bi Huabao served as keynote speakers, with Attorney Yang Siping, Member of the Trademark Law Committee of the Beijing Lawyers Association, providing concluding remarks.

At the outset of the event, Attorney Shi Yujie extended a warm welcome to all guests on behalf of Jia Law Firm. He emphasized the critical importance of not guilty defense cases for the professional development of criminal defense attorneys, noting that successfully handling such cases not only demonstrates a lawyer's expertise but also embodies legal justice and fairness—serving as the finest hallmark of a professional attorney. Finally, he sincerely hoped all attorneys would gain valuable insights from this event.

Attorney Bi Huabao used a complex not-guilty defense case as a starting point to meticulously dissect the entire process from the first trial to the second trial, then back to the retrial of the first and second instances, culminating in the dismissal of all charges and non-prosecution (acquittal). The case involved multiple charges including counterfeiting registered trademarks, selling goods bearing counterfeit registered trademarks, producing and selling counterfeit products, and contract fraud, spanning a lengthy period with complex procedures. Through meticulous case analysis, Attorney Bi demonstrated how to gradually uncover the truth in seemingly ironclad cases by challenging expert reports, pinpointing core elements, and systematically examining factual details. Throughout his detailed analysis, Attorney Bi also shared key strategies and practical advice for handling such cases. He emphasized that lawyers defending clients against criminal charges must maintain a skeptical mindset and critical stance, daring to deeply dissect cases from a professional perspective. They should never blindly accept any evidence and must consistently evaluate cases through the lens of innocence or mitigating circumstances.

Drawing on his extensive experience in criminal defense, Attorney Xu Fadong shared insights and strategies for mounting a not-guilty defense. He emphasized that a lawyer's professional expertise and dedication are central to the success of such defenses. Through specific case examples he handled, he explained that when confronting complex and challenging cases, attorneys must swiftly and accurately assess the nature of the case, persuade clients to maintain their not-guilty stance, and actively mobilize family members to persevere in facing litigation challenges together. Attorney Xu further emphasized the critical importance of effective communication with judges and prosecutors, asserting that awakening their sense of impartial reasoning and empathy is key to securing not guilty verdicts. He shared valuable insights from his practice, detailing how repeated meetings with prosecutors and judges, coupled with patient communication and thorough legal reasoning, ultimately persuaded them to adopt his not guilty defense arguments.

During the event's commentary session, Attorney Yang Siping offered high praise for the case study presented. She noted that the case not only involved complex procedures and intricate legal issues but also encompassed multiple legal relationships spanning criminal, civil, and administrative law, fully demonstrating the attorney's professional expertise. Drawing on her own specialized field, Attorney Yang specifically highlighted the risks associated with the use of registered trademarks in the case and the implications for corporate compliance. She further advised that when handling such complex cases, attorneys should prioritize cross-disciplinary knowledge acquisition and cultivation, focusing on developing keen risk awareness to better navigate diverse legal challenges.
