Q: Please briefly introduce yourself.

Lawyer Wang Dayu:

Hello, I am Wang Dayu lawyer of JAVY law firm. I have worked in a variety of positions, began to participate in the work of the Chinese Academy of Social Sciences, a research institute as a political researcher, mainly responsible for state-owned enterprises consulting business, local government legislation and 14th Five-Year Plan research; and later returned to the family business, from the lowest level of the construction workers to do, and gradually grow into a project manager, the business line supervisor, the personnel department manager and the three company's executives, but ultimately restored to the free body, I chose my love the legal profession.

Currently holding social positions include director of the Qilu Economic Research Institute's legal centre, director of the Chinese Ethics Society, and actual administrator and legal advisor of several central enterprises' long association units, though gradually disengaging to focus on the main legal profession.

Q: What was the opportunity that made you choose to join Jia Law Firm?

Lawyer Wang Dayu:

After communicating and understanding with Director Cao Chunfang, I felt that Jia Law Firm was destined to become a great law firm. It is because the law firm is open to the world that I chose to join. The highlight that attracted me the most to Jiali Law Firm is:

Q: What have you learnt from your previous work experience or how has it influenced you to change your career to a lawyer?

Attorney Wang Dayu:

I miss that part of my life, it was very hard and very fulfilling. As a liberal arts student studying law, I was sent to a construction site where I had to read and understand the drawings before I could communicate the next work plan, and a working environment where I had to co-ordinate the relationship between the supervisory authority, the owner, the general contractor and the workers in order to ensure the normal progress of the project, and I could only keep up with them with efforts beyond the ordinary people's efforts.

I've also always believed that one doesn't work for nothing, even if it has nothing to do with your main job. However, law being a discipline with inevitably blends with other industries, my previous experience has really helped me immensely in my current practice in the field of construction contract disputes, allowing me to understand more clearly the needs and pain points of my clients and to give the best possible solutions that are not limited to the law.

Q: As the heir of a private enterprise and also a lawyer, how do you think about the matter of ‘succession’?

Lawyer Wang Dayu:

Excluding the part of public-private partnership after the founding of the country, China's private economy is gradually developed and matured from the reform and opening up, which is only fifty years ago, not more than a generation. In particular, enterprises that have grown up after 2000 are facing a common problem: how to ensure the longevity of the enterprise and how to ensure that the family's wealth does not shrink.

There is no standard answer to this question, especially in China, there is no mature model and successful cases to learn from, because the business direction of each enterprise and the industry situation is not consistent. With the help of my position as a political researcher, I have conducted field research and interviews with a steel group in Shanxi (where the founder died unexpectedly), a pharmaceutical group in Shandong (which triggered a series of domestic and international fiduciary lawsuits), and a certain for group (the earliest technology company in China to be authorised for trade unions to hold virtual shareholdings).

Combining my personal experience and the current pilot of my own business, I have concluded that it is better to keep a job than to start a business. Unless the second generation as the successor has the attribute of ‘creativity’ and is able to start a business internally or break out in a better direction on its own, the best way to deal with the situation is to separate the development of the business from the inheritance of the wealth.

The best solution is to separate the development of the enterprise from the inheritance of wealth. Early share reform or equity incentives, under the guidance of the founder to train the next generation of internal and external combination of leadership group, so that they understand the soul of the enterprise, inherit the founder's spirit, continue to make a bigger ‘cake’ and ensure that the founder's family can proportionately share more ‘cake’, is the optimal solution, but also the best solution. Only the optimal solution and the most responsible approach for the next generation. Of course, this is still within the scope of domestic legislation, and it is also the direction of the services I can provide as a lawyer.

Q: What other hobbies do you have outside of work?

Lawyer Wang Dayu:

Cooking. This is not a high hobby, but for me, can let me rest my brain, if you have to give it what meaning, is the fire is very important, more than one point is scorched, less than one point is not out of the pot gas.

Isn't this also the case with the profession of a lawyer? If the fire is not hot enough, some programmes cannot be negotiated and some things cannot be done. So how to match the programme nutritionally balanced, the taste of the North and South of the world is appropriate, to facilitate the fire in place, is also one of the contents of the lawyer's work.

Another is to see the original literary history books, which is purely a personal preference, more than a few thousand years before how people live, is how to do things on the situation, or a little good.

Q: What are your personal goals for the last three to five years?

Attorney Wang Dayu:

I personally do not like to make a few years of goal planning this thing, in fact, do business or lawyers are the same, is based on the level of your thinking and experience growth, according to the personal situation and the development of the times to adjust the direction in a timely manner. For example, this autumn if the good news, Taiwan has been recovered, then I will certainly apply to participate in the construction of the Taiwan branch of the Jia Law Firm, but this can be used as my three-year goal planning, probably not, after all, when Taiwan is recovered, I have not yet said.

So, always keep a heart of love, always follow a philosophy of struggle, always improve a little bit more than yesterday, better than the so-called goal planning, every day to improve 0.1 per cent, three years later you will find that you have grown from a sapling to a big tree, the life of the compound interest is certainly more than the bank to give.

Q: What is your practice philosophy or life motto?

Lawyer Wang Dayu:

We all learnt Voltaire's saying when we were young, life is in motion, I think this can be changed, life is in ‘tossing’. I love the profession of lawyer, so I am willing to ‘toss’, willing to chase the original meaning of the existing provisions, to find a new line of opportunity for the customer; willing to the un-legislated, out of a new road.
