As the holidays approach, more and more negative news on the hotel industries has been covered by the media, such as the consumers were rejected by the hotel after successfully booking rooms, or the hotel illegally provided stairwell rooms to consumers, and some online booking platforms secretly increased the list price for rooms without the knowledge of homestay operators. JAVY’s partner Tian Qiuying Esq. commented on this issue when interviewed by Beijing Traffic Radio.
Ms. Tian suggested the following tips: 1. the consumer should choose reliable platforms when booking a room, such as the official online booking platforms operated by the hotels, as well as authentic booking apps. 2. After booking the room, it is advised to contact the hotel to confirm if the room has been successfully booked. 3. If the actual room turns out to be different from the booked one, the consumer has the right to ask for remedy, such as partial refund, it is advised for the consumer to collect evidence in such circumstances.
As Ms. Tian pointed out, if a consumer is rejected by the hotel, they may ask the booking service provider to interfere, or request a consumer association to mediate, or complain to the relevant administrative department, or file a lawsuit to the court. If the hotel refused to perform its obligations under the contract, the consumer may request the hotel to fulfil the contract, or complain to the relevant administrative department/ consumer association, or file a lawsuit to the court. If the case involves consumer fraud, they may be entitled to treble damages.
