In this episode of JAVY Talk Show, our partner Liu Xinping Esq. shared his 20 years of experience in the legal industry with us. Mr. Liu specializes in areas such as compliance, dispute resolution, and criminal law.
Q: Could you briefly describe your past experience?
A: I graduated from CUPL with a Master of Law degree, and Dalian University of Technology with a Master of Public Administration degree. My social titles include: ambulanceman of Red Cross Society of China, representative of the 7th municipal congress of Panjin, member of the 9th CPPCC Panjin Committee, legislation counsel of the standing committee of the municipal congress of Panjin, arbitrator of Panjin Arbitration Committee. I have been advising clients on foreign investment, government legislation, judiciary & administration, criminal defense and other fields for more than 30 years.
Q: What would be the impact of switching from an associate to a partner for you?
A: I’ve always been inspired by JAVY’s culture, goals and management system, as well as the passion and professionalism of my colleagues. I’m hugely excited to become a partner at JAVY, this is not only a promotion in my professional career, but also means greater responsibility and commitment. From this point on, I shall not only serve my clients, but also work on cultivating future lawyers, as well as the development of our law firm.
Q: What’s your most focused area of expertise? And what is the greatest challenge of this area?
A: My main focus is administrative litigation and reconsideration. Because government agencies weld great administrative power, the citizen side is at an obvious disadvantage, there are a few tactics they should consider before filing the case: 1. Give priority to administrative reconsideration, because the process is free of charge and also speedy, and allows the citizen to acquire evidence early, if the citizen wins, the government must obey the decision. 2. The application for reconsideration must be brief but contain all elements, and avoid being too simplistic or overly detailed. 3. The applicant must present valid and sufficient evidence. 4. The application or litigation must be filed pursuant to statute of limitations.
Q: What’s your advice to new & young lawyers?
A: I know nowadays new lawyers face a lot of challenges, but in my opinion they must learn, adapt and accumulate experiences. Here are some of my tips: First, always maintain your professional integrity. Secondly, be patient and earn the clients’ trust & reputation through your hard work. Thirdly, consider the long-term gain instead of short-term benefits. Fourthly, be meticulous, but also efficient.
Q: As a partner of JAVY, what are your hopes for the firm?
A: JAVY is expanding its business rapidly in the past few years, the firm is also building its reputation as a national excellent law firm. I strongly believe that JAVY will become a world-class law firm under the leadership of the management committee, as well as through the joint effort of all partners and colleagues.
