Q1Welcome lawyer Yuan Jun to join the JAVY family. First of all, please introduce yourself.

Lawyer Yuan Jun：

Hello everyone, it is a pleasure to join JAVY Law Firm. I graduated from college in 1994 and started practicing law in October 1998. After working as a lawyer for several years, I entered the School of Law of Renmin University of China as a graduate student and obtained a master's degree in law. Later, I obtained the qualification of patent agent and the qualification of fund practitioner.

Since practicing, I have mainly engaged in litigation-type legal services, and have undertaken some difficult cases with social influence, especially in the criminal defense of economic crimes, financial crimes, civil and commercial litigations of contract disputes, as well as patent and trademark infringement. I have accumulated rich experience in intellectual property litigation. Years of practice experience I have also made me feel the importance of an innovative, rigorous, efficient and cooperative working environment to a lawyer's professional growth.

Q2What made you choose to join JAVY Law Firm? What is your impression of JAVY?

I came to JAVY because of the recommendation and introduction from one of my friends. By chance, I saw the recommendation materials and recruitment information of JAVY Law Firm sent by a friend through WeChat. After communicating with the principals of the law firm, I found that the development philosophy and direction of the JAVY Law Firm coincided with my personal expectations, so I joined the JAVY Law Firm without hesitation.

After the recent period of getting along with the lawyers here, the deepest impression of JAVY Law Firm is its corporate culture and working atmosphere. It is different from the same high-rise buildings, where I feel more humanistic atmosphere. The environment is beautiful, surrounded by green trees, and the office environment like a single-family villa makes me feel the warmth of home. Whether it is a partner, a practicing lawyer, or a staff member in various departments such as personnel, administration, finance, risk control, branding, marketing, etc., everyone has a high sense of responsibility and rigorous work attitude towards his or her own job, which leaves me with deep impression. I always think it is very important to be serious and responsible, because "details determine success or failure", no matter what, only by doing it seriously can it be successful. Of course, in a sense, doing things seriously is itself a kind of success in life.

Q3What fields do you currently practice? What is the most impressive thing about your career?

Lawyer Yuan Jun：

Since practicing, my practice areas have mainly focused on criminal defense, civil and commercial litigation and intellectual property litigation. Here, I would like to share with you two kinds of profound experiences.

First, a refined defense and agency model. For litigation business, how to determine an effective litigation strategy and thinking-way is the difficult point, and the method and way to solve this difficulty is actually a refined defense and agency model. The refined defense and agency model actually emphasizes the role of details.

Last year, in the case of a large central enterprise that I represented for a contract dispute, it was the parties and lawyers who worked together to discover the truth behind the surface evidence such as written sales contracts, receipts, invoices, etc., and finally confirmed the facts of the case. The relationship between them is not the sales contract relationship claimed by the plaintiff, but a closed-loop financing trade relationship called sales and borrowing, which was finally recognized and accepted by courts at both levels. In the first instance of the original Kelon Electric Gu Chujun's illegal disclosure and non-disclosure of important information, it was the defender who discovered many details errors and flaws in the twenty-two forensic accounting appraisal reports, and applied for the appraiser to appear in court for questioning. In the event that the appraiser cannot make a reasonable explanation, the people's court finally determines that the part of the evidence of the prosecution should not be used as the basis for the verdict.

Therefore, details are very important. In an ordinary criminal case, we must start by preparing the examination records, cross-examination opinions and question outlines; in an ordinary civil case, we must pay attention to reviewing and verifying every piece of evidence, and digging out the truth behind the evidence happening.

The second is a persistent, serious and responsible attitude. In my years of practice experience, many of the cases I represent have gone through the first instance, the second instance, the retrial and the second instance, and some cases have even been retrialed. Fortunately, the final results of some cases are satisfactory. Some defendants were finally acquitted, some were exempted from criminal punishment, and some were finally corrected for wrong judgments in civil cases. In this process, the serious and responsible attitude and perseverance of the lawyer handling the case are essential.

Q4In your opinion, what kind of lawyer is considered a good lawyer?

Lawyer Yuan Jun：

I personally think that a good lawyer must have the following qualities: First, the ability to learn consciously and extensively. New fields and new types of legal services require every lawyer to constantly enrich their knowledge, to update their concepts, and keep learning. Second, lawyers represent cases, defense and representation ideas are very important. Therefore, a good lawyer must have clear logic, careful thinking-way, strong ability to analyze problems, and the ability to respond and debate on the spot during the trial. Thirdly, a good lawyer must also have a serious, responsible and persistent work attitude, which should also be the core quality of a good lawyer.

Q5What are your hobbies outside of work? Is it affected by occupation? Are these hobbies helpful to your career?

Lawyer Yuan Jun：

In my spare time, I like reading and swimming, and I also travel when I can. These hobbies, seemingly ordinary, allow me to broaden my horizons, to think deeply, to maintain a positive and optimistic attitude, and have more passion and fighting spirit in my work.

Q6What are your goals and plans for the next three to five years?

Lawyer Yuan Jun：

In recent years, I hope that on the basis of continuously strengthening and refining my existing business, I can make breakthroughs in intellectual property litigation, especially criminal defense of intellectual property crimes and standard essential patent litigation.

This is new environment, new starting point, I hope to go hand in hand with everyone here, to support each other and make progress together.
