In April 2023, JAVY’s partner Li Zonglin Esq. received a judgement from a Heibei Court for the retrial case she’s been working on for 4 years, she described the case as a hard-earned but satisfying victory.
The client is Mr. Shi, a weathered man in his 60s. Back in 2007, he worked as a contractor for Sanzhi Group and Shougang Jingtang Company, both are large construction corporations. However, after the completion of the construction, the companies refused to pay him as promised. Mr. Shi tried to reason with the companies but they denied there was even a contract, Mr. Shi’s wife died in grief in 2014. He then sued the companies in court, but failed twice, the retrial was his only chance.
After taking the case, Ms. Li thoroughly examined the court documents and found strong evidence that supported Mr. Shi’s claims, but ignored by the court. Through her huge effort, the case was finally granted a retrial at Tangshan Intermediate Court. After a heated debate at the court, the case was remanded to Caofeidian district court for reconsideration.
Ms. Li argued strongly in the district court and won a judgement supporting’s Mr. Shi’s claims, but this wasn’t over yet, Sanzhi group filed an appeal and insisted that there wasn’t a contract. However, Ms. Li successfully refuted the appeal and the judgment was upheld, the dust has finally settled after 15 years.
Ms. Li commented that the key to winning this case is evidence, by utilizing the evidentiary chain to restore the truth, she successfully persuaded the high court to grant the retrial. She also suggests that business owners should try to collect and keep evidences as best as they can when signing contracts involving significant amounts, just in case of potential litigation.
