The case dates back to 2020, when the defendant, acting as a traffic promoter for a domestic e-commerce platform, used a script he had written called “Online Shopping Assistant” to promote traffic and earn promotion fees. However, this method of promotion using scripts caused the e-commerce platform's backend system to misidentify the traffic, leading to errors in the calculation of promotion fees. The e-commerce platform discovered this vulnerability in October 2024 and reported it to the authorities. The public security authorities subsequently initiated an investigation into the case under the charge of illegal destruction of computer information systems. By the time the case was uncovered, the number of involved computer information systems had reached over 30,000, with illicit gains amounting to tens of thousands of yuan.

They proposed changing the charge to “illegal control of a computer information system,” as well as submitting applications to change the compulsory measures, request lenient punishment, and apply for probation. During the prosecution review stage, the procuratorate ultimately accepted the lawyers' opinions, changed the charge to “illegal control of computer information systems,” and proposed a sentencing recommendation for probation, successfully changing the defendant's compulsory measures to bail pending trial. During the trial, the legal team further elaborated on the defendant's mitigating circumstances, emphasizing that the social harmfulness was relatively minor and the likelihood of reoffending was low, requesting the court to grant leniency.
Ultimately, the Daxing District People's Court of Beijing comprehensively considered the facts and circumstances of the case, adopted the defense's arguments, and imposed a lighter sentence within the statutory sentencing range while applying probation. This outcome not only reflects the authority of the law and upholds the bottom line of judicial fairness but also embodies the criminal policy of combining leniency with strictness, granting the defendant an opportunity to reform and reintegrate into society.
