Ms Yang Siping, Member of the Trademark Law Committee of the Beijing Lawyers Association and Partner at JAVY Law Firm, delivered the opening address. The event featured a keynote presentation by Mr Zhang Wei, a senior solicitor and patent attorney.
At the outset, Ms Yang Siping extended a warm welcome to all attendees on behalf of JAVY Law Firm, briefly outlining the firm's development journey, professional specialisations, and distinguished achievements within the intellectual property domain. She emphasised that within the current market landscape, the legal services sector demands increasingly specialised expertise, necessitating lawyers to refine their vertical specialisations to achieve depth and precision in order to better serve client requirements.
Drawing upon his extensive experience in patent case representation, Mr Zhang delivered an insightful lecture. He commenced with foundational patent knowledge, detailing China's three patent types under the Patent Law – inventions, utility models, and designs – along with their respective characteristics and key application considerations.
Subsequently, Mr Zhang delved into the representation techniques for patent infringement litigation cases. He emphasised the decisive principle in such litigation: the accused infringing technical solution must incorporate technical features identical or equivalent to all those specified in the claims to fall within the scope of the patent protection. Additionally, he shared practical skills including how to develop target clients for patent infringement litigation, how to uncover clients' latent needs, strategies for developing second-instance cases, and factors to consider when preparing business quotations.
Regarding patent invalidation representation, Mr Zhang elaborated on the motivations for filing invalidation requests, the types of examination decisions, and business development strategies for different outcomes. He particularly stressed the importance of identifying relevant prior art and applying the three-step test to assess inventive step. Furthermore, he provided an in-depth explanation of comparison methods for design patent invalidation, alongside the principles of holistic observation and comprehensive assessment. Mr Zhang's presentation was characterised by clear structure and rigorous logic, providing attending solicitors with enhanced clarity regarding patent invalidation proceedings.
During the interactive session, solicitors actively posed questions, sparking vigorous discussions spanning multiple dimensions including patent applications, client acquisition, client communication, and social media-based client engagement. The keynote speaker patiently addressed these queries, with participants collectively generating innovative insights to address practical industry challenges.
