Q: Please briefly introduce yourself.

Hello, I am JAVY LAW FIRM partner, Chongqing Branch Director Tang Zhangfu lawyer. At present, he is the professional staff of Chongqing Municipal Federation of Industry and Commerce Chongqing Third Party Supervision and Evaluation Mechanism for Compliance of Enterprises Involved in Cases, the director of Chongqing Chamber of Commerce for International Cooperation of Private Economy, and the mediator of China Council for the Promotion of International Trade/China International Chamber of Commerce Mediation Center, and so on. He has also been invited as a special guest lawyer for Chongqing TV's “Yu Police Frontier” program, and has been invited for interviews by Chongqing TV's “Case Claims”, “Barristers Online”, “Chongqing Discovery” and other legal programs. Won the first thousand young lawyers in chongqing leading talent, the best criminal defense lawyer in 2020, shortlisted for the best young lawyers in chongqing in 2017 and other honors.

I have been practicing law for 12 years, and have been engaged in legal work for 17 years, and I am committed to doing my best in every case and providing high-quality legal services for every client. I have handled the “Yunlianhui pyramid scheme case”, which is one of the top ten economic crime cases in Guangdong involving 130 billion yuan with great influence in the whole country, and successfully defended the case of Chongqing entrepreneurs investing in Guizhou allegedly suspected of more than 600 million yuan of fraud to save the huge losses, and provided legal consultancy and preventive legal risk services for many entrepreneurs. He has rich experience in handling cases in the fields of corporate legal counsel, corporate compliance risk prevention and control, investment and mergers and acquisitions, commercial dispute resolution, legal risk prevention and control of investment in Belt and Road countries, asset restructuring, criminal defense of new types of crimes, exemption of entrepreneurs from criminal liability, prevention and control of legal risks of overseas investment + immigration, and separation planning of extramarital affairs.

Q:What areas of legal services are you mainly committed to, and what do you think are the difficulties in handling cases in these areas?

I mainly focus on commercial contract disputes, criminal defense of economic and official cases, overseas investment and immigration, and other difficult and complicated cases.

For commercial contract cases, I believe that the key to deal with the background of the case and the contractual rights and obligations are strictly in accordance with the contract, whether there are other uncontrollable factors that lead to failure to perform the situation, followed by the organization and control of the evidence, the need to claim whether there is sufficient evidence to support the claims, and so on.

For criminal defense cases, I believe that the important difficulty lies in the crime and non-crime, the seriousness of the crime and the minor, based on the determination of whether the basic evidence can be found guilty of a crime. In the handling of cases, I have encountered a few originally innocent cases were criminal case transferred to prosecution, as a defense lawyer, I timely analysis of the key points and the prosecutor's office to communicate or to the court for defense, only to prevent the innocent person was prosecuted for a crime. This requires our lawyers to grasp the case and the law to determine the crime.

For overseas investment and immigration business cases, I think the key point is to understand the relevant overseas legal regulations as well as the operation process, and also need to have a lawyer who has cooperated with a professional overseas lawyers' organization to serve together, otherwise Chinese lawyers are unable to provide overseas legal services directly.

My deepest impression is that in 2019, I handled a case in which a small loan company in Guizhou was suspected of fraud, involving an amount of more than 600 million yuan. As the first defender of the first defendant in the case, i.e. the chairman of the small loan company, I was involved in more than 110 volumes of case files. Due to the extreme complexity of the case, the team spent several months organizing and analyzing the case materials and combing them into a number of visual charts in order to help the prosecutor's office and the court understand the case. After three consecutive days of trial, I put forward a sufficient defense opinion that the case was not enough to constitute fraud, which was eventually adopted by the court and ruled that the case did not constitute fraud. This case not only helped clear the suspect of fraud, but also saved the client from a huge loss of over 600 million dollars that could have been forfeited.

Q:As a senior lawyer, what successful experience and advice can you share with young lawyers?

I am a “grassroots” lawyer, and based on my limited experience, I suggest that within 3-5 years of practicing law, young lawyers should think less about raising their income to meet the basic needs of life, and more about taking the initiative to learn and consider improving their professional ability. They should handle various types of cases, accumulate practical experience, learn more scientific case handling skills, use more legal tools for case handling, and improve efficiency. Only when the professional ability is improved, can we have the ability to “catch” the big and important cases when they come.

When you have been practicing for more than 5 years, you should participate more in social activities to enhance your network and gain case resources, and accumulate experience by handling more cases. In the first 6 years of my practice, regardless of the fee, I handled each case seriously and meticulously, so that my clients recognized my professional ability, and naturally, my business would increase in the later stage. A truly powerful lawyer must have crossed thousands of mountains and experienced thousands of obstacles to develop his skills.

Q:Lawyer's work is by no means time-saving, how do you balance work and life?

Before I set up our Chongqing office, I spent all my time after work, on weekends and holidays, with my family and myself, not working. I enjoy sports, paragliding, drinking tea at home or planting flowers. I don't usually bring my work home, and I don't think about my work when I'm resting, so I don't interfere with each other, and I'm highly efficient.

However, after deciding to set up the Chongqing office, the pressure brought by various aspects came along with it. Almost all of my personal rest time was spent on the construction of the firm, and now I don't have much rest time, and as for relieving the pressure, I may just brush up on my dramas once in a while on weekends.

Q:You also hold many social positions and are enthusiastic about public welfare affairs, how do you think this helps in practicing law?

The positions I have held in the Law Society are mainly professional ones, which help the mutual exchange of professional competence and enhance the influence of the profession. The committee positions are mainly to do pro bono with my own professional ability, and at the same time to enhance the brand power of the law firm. The position in the Chamber of Commerce organization is mainly to know more excellent entrepreneurs, enhance the network, and help the business to a certain extent.
