On December 7, 2023, JAVY Law Firm held a seminar on studying foreign law and cultivating international legal thinking, hosted by our senior partner Wang Chunmin Esq., joined by Liu Zhiqiang Esq., Senior Partner of Yingke Law Firm, and Zhao Qin Esq., Partner of Beijing Dacheng Law Firm. All three lawyers are among Ministry of Justice's Advanced Training Program for Foreign Lawyers.
As China's international status continues to rise with the ongoing development of economic globalization, its role in global governance has become crucial. This has placed higher demands on the strategic layout of foreign-related legal work, strengthened the construction of foreign-related legal systems, and raised the bar for cultivating talents in foreign-related legal affairs to propel China onto the world stage.
Mr. Wang, drawing on his extensive experience in foreign legal services, provided valuable insights and suggestions to the lawyers present. The purpose of the seminar, as expressed by Wang, was to disseminate thoughts on the construction of foreign-related legal systems, explore measures for cultivating talents in foreign legal affairs, broaden the perspective of legal services, establish thinking in foreign-related legal matters, enhance legal service capabilities, and continuously improve the professional capabilities of Chinese lawyers in foreign services.
During the lecture, Mr. Wang outlined the essential qualities that foreign-related lawyers should possess. He made in-depth comparisons between the legal systems of common law and civil law, highlighting differences in logical thinking, specific legal rules, and trial procedures. Furthermore, he emphasized the importance for Chinese lawyers to study common law, given the significant number of legal disputes involving Chinese companies in international settings. He provided practical learning methods and experiences, recommended books and movies, and encouraged lawyers to tailor their studies based on their own levels.
Mr. Liu provided a comprehensive guide for foreign-related lawyers, covering knowledge of foreign legal systems, specific foreign legal institutions, and an introduction to international treaties. He delineated a specific path for foreign-related lawyers in terms of what to study, how to study, the required level of proficiency, and whom to serve.
Ms. Zhao observed that Chinese lawyers currently face challenges such as the elevation of clients' legal competence, especially with mid-level lawyers entering legal teams, resulting in a noticeable trend toward the integration and upscale development of non-litigation business. She highlighted that long-term practitioners in foreign-related businesses generally have higher average legal competence than other clients. Moreover, an increasing number of clients are demanding that Chinese lawyers manage the work and outcomes of foreign lawyers.
During the Q&A session, the attending lawyers actively participated, posing questions on topics such as "How can Chinese lawyers engage in foreign-related business?" and "How to expand foreign-related case sources?" The three main speakers responded patiently and in detail to the questions.
The seminar was rich in content, covering a wide range of topics, and was both instructive and practical. It attracted over thirty lawyers from within and outside the firm, as well as corporate legal professionals. The seminar enhanced the participants’ understanding of foreign-related legal services, and received high praise and approval from the participants.
