On the afternoon of September 22nd, 2023, JAVY Law Firm successfully hosted the "Enterprise Trademark Rights Protection and Risk Prevention Knowledge Sharing Seminar" at its E2 building. The seminar, led by attorney Yang Siping from JAVY Law Firm, attracted about twenty lawyers and various industry professionals. The event was also livestreamed on JAVY's online platform, drawing over a thousand viewers and receiving more than five thousand likes.
The seminar covered four main topics:
1. Basic knowledge of trademarks and brands.
2. How to obtain trademark rights.
3. Protection and risk prevention of trademark rights.
4. Typical case studies.
Yang Siping initially explained the concepts and distinctions between trademarks and brands, emphasizing that trademarks are fundamental to brand creation and identification.
China sees a significant annual volume of trademark applications (approximately 10 million), with over 40 million registered trademarks. However, the rejection rate is high at 50%, and the examination period has shortened to three months. Many registered trademarks remain unused, leading to increased cases of oppositions and invalidations. Some enterprises resort to rebranding or purchasing trademarks at high costs to improve registration success rates.
Using multiple cases of trademark rejections, Lawyer Yang detailed absolute and relative reasons causing rejections. She shared legal strategies based on her extensive experience to help lawyers better understand trademark registration processes.
Lastly, Ms. Yang provided advice on managing trademark risks: timely and comprehensive trademark registration, establishing a comprehensive trademark alert system, and crisis prevention strategies for brands.
The seminar provided practical insights and guidance, enhancing lawyers' ability to diagnose trademark issues and advise clients effectively, while emphasizing the critical role of trademarks in corporate protection and legal awareness.
