Interview with JAVY Ma Zengwei: Do things professionally and treat people with integrity.
In order to shorten the distance between JAVY and lawyers, JAVY has launched a series of "JAVY Interviews" series, let us understand the stories behind each lawyer.
There is no end to learning. In order to study the professionalism of lawyers’ practice, Ma Zengwei went to Chicago-Kent School of Law for further studies and pursued a master’s degree in international intellectual property law. He believes that professionalism is the basis and premise for lawyers to provide better services to clients. He is the guest of this interview, lawyer Ma Zengwei.
Q1:Welcome lawyer Ma Zengwei to join the JAVY family. First of all, please introduce yourself.
Lawyer Ma Zengwei:
Hello everyone, it is my great pleasure to join JAVY Law Firm. I started practicing as a lawyer in October 2008. Before that, I have been mainly engaged in civil and commercial litigation and legal counsel. Later, I began to think about the professionalization of lawyers' practice, which should be the general trend of lawyers' development in the future. In the process of practicing, I have dealt with some intellectual property business, and in recent years, the state has strengthened the protection of intellectual property rights. After careful consideration, I am ready to take intellectual property rights as my future professional direction. So, in 2017, I went to Chicago-Kent Law School to study for a master's degree in International Intellectual Property Law, hoping to lay a solid foundation for future professional development. In the future, I hope to apply what I have learned to my own practice and specific cases.
Q2:What was the opportunity that made you choose to join JAVY Law Firm? After this period of time together, what is your impression of JAVY Law Firm?
Lawyer Ma Zengwei:
When I was preparing to take intellectual property as my future practice direction and looking for a larger practice platform, I saw the recruitment news sent by JAVY. Then, I carefully studied the various information of JAVY, and found that this is an excellent law firm in the country, and this is the platform I have been looking for. When I met and communicated with the director of JAVY, I could also feel the determination and confidence of the director of the law firm to make JAVY bigger and stronger. I believe that JAVY will definitely have more room for development in the future. So, after careful consideration, I decided to switch to JAVY! After getting along for this period of time, I found that the functional departments of JAVY Law Firm are very dedicated, and they are thinking about how to provide better services and platforms for practicing lawyers. With such a professional team, JAVY Law Firm will definitely become more and more in the future. the better.
Q3:What areas of legal services have you mainly focused on since your practice? What do you think is the difficulty in handling cases in this field?
Lawyer Ma Zengwei:
Since my practice, I have mainly provided legal services in the field of insurance, real estate and intellectual property.
In the field of insurance, the difficulties focus on the principle of proximate cause of the insurance law, the nature of the standard terms of insurance clauses, the insurance company's obligation to remind and explain, the policyholder's obligation to inform and so on. In the case of major disputes, the court often focuses on the risk-spreading function of insurance, and decides that the insurance company loses the case on the grounds that the standard clause and the insurance company have not fulfilled the obligation of prompting and informing. Therefore, in this case, how to maximize the protection of the interests of insurance companies is a major difficulty.
In the real estate field, construction project contract disputes may involve issues such as project appraisal, project quantity verification, etc. The case cycle is long, and a case may last for two or three years or even longer, which involves the lawyers who handle the case. The amount is generally relatively large, and a little carelessness may cause significant losses to the parties, requiring lawyers to have a strong ability to bear pressure.
In the field of intellectual property, lawyers are required to be highly professional, and copyright business requires lawyers not only to have practical experience, but also to have strong theoretical research and learning capabilities. The patent business has higher barriers. If you do not have a relevant science and engineering background, you may not be able to understand the technical characteristics of patents and the claims of patent documents.
Q4:In your opinion, what kind of lawyer can be called a good lawyer?
Lawyer Ma Zengwei:
I think a good lawyer should have at least the following characteristics: First, they should be professional enough, which is the basis and premise for lawyers to provide better services to clients. Secondly, we must have the determination and confidence to pursue fairness and justice. When encountering difficult cases, we must be able to pursue legal fairness and justice without fear of difficulties. Even if there is a glimmer of hope, we must make unremitting efforts to maximize the interests of our clients and to realize the social value of lawyers in the process of serving clients. Finally, you must have good professional ethics and conduct, treat people with integrity, especially in your interactions with customers, and don't lie to customers.
Q5:Outside of work, what hobbies do you have? Are these hobbies helpful to your career?
Lawyer Ma Zengwei:
In my spare time, I mainly like playing basketball and swimming. Health is the capital of lawyers' practice. If lawyers are not healthy, it is difficult to adapt to the high-intensity nature of work in the legal industry. Therefore, it is necessary to exercise.
Q6:What are your personal goals and plans for the last three to five years?
Lawyer Ma Zengwei:
I hope that in the next three to five years, I can make greater progress and development in the field of intellectual property, and take intellectual property as my main business direction.
