Recently, Ge Youshan, Executive Director of JAVY Law Firm, accepted an interview with Beijing TV Station's "Beijing Chamber" column, and made relevant interpretations on the phenomenon of the over-age use of wall-hung boilers.
According to statistics, more than 800,000 wall-hung boilers with energy efficiency below level 2 are still in use in urban residential buildings built before 2015 in Beijing, of which 560,000 units have a service life of more than 8 years and 290,000 units have a service life of more than 13 years. A large number of wall-hung boilers have been used over a period of time, posing safety hazards.

In response to this phenomenon, Beijing TV’s "Beijing Chamber" column specially invited Ge Youshan, a member of the CPPCC in Chaoyang District of Beijing and the executive director of Jiawei Law Firm, to carry out relevant legal interpretations.
The program was aired on the Beijing Satellite TV News Channel on December 12.
Many people don’t know the obsolescence period of wall-hung boilers. Some people say that it is 8 years. Is there any legal basis?
Attorney Ge Youshan stated that our country issued the "Regulations on the Safety Management of Household Gas Burning Appliances" in 2008, which clearly stipulated that the waste standard for gas and wall-hung boilers should be 8 years. If it is used overdue, it may be suspected of violating the regulations. This regulation is a national mandatory standard. Article 2 of the "Standardization Law of the People's Republic of China" clearly stipulates that the country's mandatory standards must be implemented. Therefore, the 8-year service life is based on it. Whether it is an operator or a user, it should be strictly implemented in this process. If something goes wrong, some entities may be liable.
When the country formulates mandatory standards, what factors will it consider?
Attorney Ge Youshan said that the state will consider three factors when formulating mandatory standards: the first is to protect personal health from damage, the second is to protect property from loss, and the third is to protect the environment from pollution. If the combustion is not sufficient or other factors produce toxic and hazardous substances, then it is not applicable to the current theme of carbon neutrality. Therefore, this formulation conforms to the national green concept and environmental protection concept. Therefore, regardless of whether it is from a personal point of view or from the country's major policies, we should promptly replace the wall-hung boilers that have been overdue.
