She is the guest of interview in this issue-Lawyer Wang Qingqing.
Q&A
Q:Please briefly introduce your own career history, social position, honors and other information.
Lawyer Wang Qingqing:
Before I became a lawyer, I had been engaged in compliance, risk control and dispute resolution in the field of private equity investment funds. My position has also ranged from a legal commissioner to a compliance manager to a director of the legal department. In the past ten years, the main types of projects involved in the financial field include PPP projects, equity investment and financing, non-performing assets, mergers and acquisitions, and private equity funds. We have accumulated rich experience in the early stage due diligence, mid-term management and late-stage exit of these projects, and we have provided a valuable asset for the later work of lawyers.
Q:What made you choose to become a lawyer?
Lawyer Wang Qingqing:
Although I have been engaged in legal work for a long time, most of the work content has a strong similarity in nature, there are essential differences in many aspects, from the functional positioning, like "corporate lawyers" and "full-time lawyers", working methods, service objects, driving factors, value considerations, etc.
Combining with myself, choosing to change from "corporate lawyer" to "full-time lawyer", the first reason is "value enhancement". Regarding this question, on the one hand, there is the dimension of value "quantity"-full-time lawyers will face different legal needs and client groups, so the work that lawyers can do will continue to increase in terms of "quantity". On the other hand, it is the dimension of value "quality"-due to the inconstancy of service targets and the "mainstream" of clients' legal needs, the legal service plan that lawyers can plan will reduce interference factors on the path of seeking the best. .
The second consideration is "to break through myself". As we all know, any person and any industry will face the bottleneck of continued development when it develops to a certain extent, and how to break through this bottleneck is a realistic problem that has to be faced. So I have to choose to abandon the comfortable status quo, choose greater challenges, and break through the existing constraints. From a small point of view, to help clients pursue the maximum benefit within the legal framework, and from a large point of view, it is an endorsement of fairness and justice.
The third consideration is "energy transmission." I saw an article before that introduced people from different industries to talk about the characteristics of the industry. For example, it is better to state the symptoms to the doctor when you go to the hospital instead of telling you what the disease is. Because this is professional judgment. This is also true for the legal industry. For now, apart from handling cases, I can write articles, judicial cases and publish them on the public on line, especially for cases where it is difficult to judge the " Taking it for granted" from the judgment document alone. I can conduct practical analysis based on my previous professional experience, which is also part of the lawyer's sense of social responsibility.
Q:What legal services have you mainly devoted to since your practice? What do you think are the difficulties in handling cases in this field? How did you think about it at that time? What are the things that impress you most?
Lawyer Wang Qingqing:
If you don't donate yourself into your work, you will not be successful. Every solid step taken in life will bring us closer to faith. Based on previous work experience and areas of expertise, I am currently mainly engaged in commercial dispute resolution, financial field, corporate disputes, non-performing assets, and major difficult and difficult enforcement cases. Of course, since I am very familiar with these fields, in addition to continuing to pay attention to the latest laws, judicial interpretations and judicial practice trends in this field, I am also planning to form a more "more practical" team serving more customers in the field of marriage, family, and other family affairs, private lending, infringement and other fields.
As for the difficulties, hot issues, or things that impress me in various fields, I would like to make a general point of view:
First, if a worker wants to do his/her job well, he must first sharpen his/her tools. In traditional transaction-type cases, it is necessary to pre-judge the possible outbreak points of disputes during the transaction, and to fix the evidence based on the basis of the claim to facilitate the subsequent legal rights protection. This is the basis of the "fact-based" court decision.
Second, deleting the complex is simply like scissoring the after–third-autumn-tree, and marking the new like the new February flower with the different standard. Difficult and complicated cases are often the touchstone of the lawyer's skill. After a dispute occurs, the facts often have their own opinions. At this time, the lawyer must listen patiently to the details of the client's statement and extract the summary from it, find the evidence and form a chain of evidence, at least to obtain a high degree of probability or advantage probability that affects the judge’s freedom and integrity. For difficult issues in the application of the law, it may be necessary to discuss the original intention and purpose of the law, and from the perspective of interest measurement and value judgment to deduce the nature of the law on disputes, and draw conclusions that are beneficial to oneself. This is a court decision for cases by" "Law as the criterion"--this criterion.
Third, I am not afraid of floating clouds and cover my eyes, and I am at the highest level, I can see it clearly. This is the direction I pursue as a lawyer, and it is also a sincere advice to clients. In commercial transactions, especially complex commercial transactions, we must have a holistic view, and don't be blinded by "floating clouds" and interfere with judgment. For example, in the early stage of due diligence, although some costs have been paid, if uncontrollable risks are discovered, a decision must be made. We cannot pay more "opportunity costs" for the "sunk costs" of due diligence. When considering "investment", we must consider "management" and "retirement", because in most cases, "investment" and "management" are not the goals, but the ideal "retirement" is the ultimate goal.
Therefore, in general, I think that for any transaction, the design of the overall plan is the first, the risk control at each stage is the second, and the efficient and high-quality dispute resolution is the third. The above-mentioned "three- parts-into-one" are integrated and must be carried out within the legal framework. This is also the value of legal affairs and lawyers.
Q:What was the opportunity that made you choose to join JAVY Law Firm? After this time of getting along, what's your impression of JAVY Law Firm?
Lawyer Wang Qingqing:
What JAVY impressed me most is his teamwork spirit. I deeply feel that no matter which department, what field or which position, every JAVY lawyer, his or her goal is to handle each case well and serve each client well. Facing a client, whenever I encounter a problem that I cannot solve personally in handling a case or handling a project, no matter which JAVY lawyer I find, he/she will do his/her best to help me. In the face of such a strong team, this indestructible spirit of collaboration impress me quite well, I believe that in front of JAVY and JAVY people, there are no difficulties that cannot be overcome.
Q:With the rapid development of the internet, the trial of a case often comes from media and social attention, and sometimes has a certain reaction to the case itself. How do you view the influence of the mass media on the cases?
Lawyer Wang Qingqing:
The rapid development of the Internet has profoundly affected the entire society. Of course, one side of the coin is positive, and the other side may be negative, but the main aspect is still positive. The media's attention to the case will indeed have a certain impact on the trial of the case, but I think this will not change the basic trend of the case.
The most important role of media attention and public opinion is to make the case public, which is positive from the perspective of openness, fairness, and justice. However, facts and laws are always the basis for the trial of a case. As a lawyer, when the case is faced with a flood of public opinion, you must have the determination that the landslide is the same, and the elk is prospering but not instantaneous. It must be in the legal framework. Responding to public opinion in a timely manner and striving to guide public opinion, it is necessary to do a good job and lay a solid foundation in terms of facts and laws.
Q:What are your hobbies outside of your work? Is it affected by your occupation? Are these hobbies helpful to your career?
Lawyer Wang Qingqing:
Reading is an important way to think deeply about problems. The conclusions of thinking are not influenced by others except the author. I like to go to bookstores and read books when I am outside of work. Whether I admit it or not, the personal impact of my career is potentially and far-reaching. When I got this question, actually I had not considered this kind of effectness. But the fact is that most of the books I read are law and finance books, and there are also some history books. As for professional help, I believe the books I read is definitely helpful. This is mainly an impact on the way of thinking, but I really rarely quote a passage from a certain book when handling a case. I think this kind of help should also be latent and potential.
Q:What is your target plan for the last three to five years?
Lawyer Wang Qingqing:
This issue is actually quite broad. Simply we will strive to achieve the "Three Hundred’ Targets" within three years. The first is to read one hundred books; the second is to provide legal services to one hundred regular law clients, and the third is to write a hundred articles. This should be in the same line as the previous issues, namely self-breakthrough, value enhancement, and energy transmission.
