Following an appeal, the second-instance court partially reversed the judgment and awarded a small sum; however, the clients remained dissatisfied with the outcome, believing that the second-instance judgment contained errors in its findings regarding key facts such as the composition of capital contributions and the calculation of rent. After two rounds of litigation, the heirs were physically and mentally exhausted; nevertheless, in order to safeguard their legitimate rights and interests, they resolved to continue seeking legal redress.

Regarding the determination of the composition of the partnership capital contribution, he pointed out that the security deposit should not be conflated with the capital contribution; regarding the calculation of rent during the partnership period, he submitted new evidence, such as the rent-free period clause stipulated in the contract, to prove that the original judgement had over-calculated several months’ rent; regarding the determination of the value of both parties’ capital withdrawals, he used cross-examination to establish facts admitted by the opposing party, thereby supplementing the asset amounts omitted in the original judgement. His arguments were rigorous and logically sound, effectively highlighting the aspects of the original judgement that required correction.

After hearing the case, the retrial court fully adopted Mr Ning Qian’s principal arguments, finding that the second-instance judgement had indeed erred in its determination of certain facts. It corrected these errors in accordance with the law, increasing the awarded amount by nearly three times that of the second-instance judgement.

    This case progressed through three stages—dismissal at first instance, partial upholding on appeal, and a revised judgement on retrial—ultimately securing a favourable outcome for the client. The retrial judgement made findings favourable to the client on key facts such as rent calculation, capital contribution and liability for debts, with the awarded amount increasing by nearly three times compared to the second-instance judgement.
