Recently, JAVY’s Gao Feng Esq. has successfully defended a client accused of illegally absorbing 200 million RMB public deposit, by persuading the prosecutor to drop the case.
The client “Mr. A” is the legal representative of an online sales company which operated a platform that sold points to its members, netting more than 200 million income. However, the platform ultimately collapsed and the points became worthless, the angry members filed a complaint with the police, and Mr. A was arrested on suspicion of illegally absorbing public deposit.
The case involved highly complicated integral rules and large sum of transactions, even the client himself was wondering if he should plead guilty. But after analyzing the case, Mr. Gao concluded that the government did not have enough evidence to prove there were criminal facts, his analysis gave the client much hope. Then Mr. Gao communicated with the prosecutor multiple times, argued that there was no criminal fact. Finally, the prosecutor made the non-prosecution decision.
